Türkiye’de uzun dönem ikamet izni veya aile ikamet izni ile yasal olarak bulunan yabancılar, çalışma hayatına katılmak istediklerinde bazı önemli avantajlardan yararlanabilirler.
Mevzuatta belirtilen şartları taşımaları hâlinde, bu kişiler için çalışma izni başvurularında diğer yabancılar açısından uygulanan bazı kriterler aranmayabilir.
Örneğin;
-İşyerinde belirli sayıda Türk vatandaşı çalıştırma şartı,
-İşverenin belirli tutarda ödenmiş sermayeye sahip olması şartı,
Ancak bu muafiyet her yabancı için otomatik olarak geçerli değildir. Başvurunun niteliği,
yabancının sahip olduğu ikamet izni ve diğer yasal şartlar birlikte değerlendirilmektedir.
Bu nedenle çalışma izni başvurusu yapılmadan önce dosyanın uzman tarafından incelenmesi
hem işveren hem de yabancı açısından zaman ve hak kaybını önleyecektir.
Facilitated Work Permit Process for Foreigners Holding Long-Term or Family Residence Permits
Foreigners legally residing in Türkiye with a long-term residence permit or a family residence permit can benefit from certain significant advantages when they wish to participate in the workforce.
Provided they meet the conditions specified in the legislation, certain criteria applicable to other foreigners may be waived for these individuals in work permit applications.
For example;
-The requirement to employ a certain number of Turkish citizens in the workplace,
-The requirement for the employer to have a certain amount of paid-in capital,
However, this exemption does not automatically apply to every foreigner. The nature of the application, the residence permit held by the foreigner, and other legal requirements are evaluated collectively.
Therefore, having the file reviewed by an expert before submitting the work permit application will prevent both the employer and the foreign national from losing time and rights.
