Taahhütle, çalışma iznine başvurmak için ikamet alan yabancı, ikamet iznini aldıktan sonra sadece taahhüttü veren işvereni için çalışabilir. Günlük hayatta, ikamet iznini alan yabancı istediği yerde artık çalışabileceğini düşünmektedir. Unutmamalıdır ki, taahhüttü veren işvereni bu taahhüttü geri çekip, Göç İdaresine yabancı hakkında bildirimde bulunur. Göç İdaresi de kendisine bildirilen taahhüttün artık geçersiz olmasından ötürü yabancının ikamet iznini keser. Geçerli bir ikamet izni olmayan yabancı kesinlikle çalışma izni de alamaz.
Türkiye’de çalışma izinleri işveren adına düzenlendiği için, yabancı isterse kendi ülkesinden çalışma izni alarak gelmiş olsun, isterse ülkemizde işverenin onun adına vermiş olduğu taaddütle önce ikamet izni ve sonrasında çalışma iznine sahip olsun işten ayrılarak başka bir işyerinde çalışmak istediğinde yeni işvereni tarafından yeniden çalışma izni başvurusu yapılması gerekir.
Öncelikle, yabancının mevcut çalışma izninin eski işveren tarafından iptal edilmemiş olması gerekir. Eğer iptal edilirse, yabancının çalışma izni dışında geçerli bir ikamet izni yok ise; ülkemizde kaçak durumuna düşer, hiçbir yerde yasal olarak çalışamaz. Kolluk güçlerinin denetimi sonucu direkt deport edilirler. Eski işyerinde de en az altı ay çalışmış olması önem taşımaktadır. Yabancı, eski işvereninden yeni işyerinde çalışmasına muvafakat ettiğini belirten bir dilekçe
almadan yeni bir iş yerinde çalışamaz. Profesyonel destek alınmadan atılacak her adımın hem ikamet hem de çalışma izninizin iptaline veya deport kararına kadar gidebileceğini bilmenizi isteriz.
Misconceptions held by foreign nationals working in our country as domestic workers (such as TURKMEN, UZBEK and FILIPINO carers for children, the elderly and the sick) regarding residence permits and the subsequent work permits they obtain;
Under the sponsorship scheme, a foreign national applying for a work permit may, once they have been granted a residence permit, only work for the employer who provided the sponsorship. In practice, foreign nationals who have been granted a residence permit tend to believe that they can now work wherever they wish. It should be borne in mind that the employer who made the undertaking may withdraw it and notify the Immigration Authority regarding the foreign national. The Immigration Authority will then revoke the foreign national’s residence permit on the grounds that the undertaking notified to it is no longer valid. A foreign national without a valid residence permit cannot, under any circumstances, obtain a work permit.
As work permits in Turkey are issued in the employer’s name, whether a foreign national has come to the country having obtained a work permit from their own country, or has first obtained a residence permit and subsequently a work permit on the basis of a commitment made by their employer in Turkey, if they leave their job to work for another employer, their new employer must submit a new application for a work permit on their behalf.
Firstly, the foreign national’s current work permit must not have been revoked by their former employer. If it is revoked, and the foreign national does not hold a valid residence permit other than their work permit, they will be considered to be in the country illegally and will not be able to work legally anywhere. They will be deported immediately following an inspection by the law enforcement authorities.
It is also important that they have worked at their previous place of employment for at least six months.
A foreign national may not take up employment at a new workplace without first obtaining a letter from their former employer confirming their consent to their employment at the new workplace.
