Yabancılar, geçerli ikamet izinleri bulunduğu sürece Türkiye’den çıkış ve yeniden giriş yapabilirler.
Ancak bazı durumlarda yabancı, yurt dışındayken ikamet izninin bitimine çok kısa bir süre kaldığını fark edebilir.
Örneğin; öğrenci ikamet iznine sahip Azerbaycan vatandaşı bir yabancı yaz tatili için ülkesine gitmiş ve Türkiye’ye döndüğünde ikamet izninin bitimine yalnızca 15 gün kalmış olabilir.
Yabancı, bu 15 günlük süre içinde ikamet izni uzatma başvurusu yapmaz ve ikamet izni sona ererse, Türkiye’ye son girişinden başlayan 90 günlük vize muafiyeti süresi devam ettiği için, bu süre dolmadan öğrenci ikamet izni başvurusunda bulunabilir. Bu durumda cezai işlem uygulanmaz. Fakat, vize muafiyeti ile başvuracağı için uzatma yerine ilk kez başvuru yapıyormuş gibi başvuru yapmak zorundadır.
Ancak bu uygulama her yabancı için geçerli değildir. Yabancının uyruğu, vize veya vize muafiyeti süresi ile Türkiye’ye giriş şartları birlikte değerlendirilmelidir.
Yanlış işlem yapılması hak kaybına neden olabileceğinden, başvuru öncesinde kişisel durumun uzman kişiler tarafından değerlendirilmesi büyük önem taşımaktadır.
What Should a Foreigner Do When Returning to Türkiye Just Before Their Residence Permit Expires?
Foreigners may exit and re-enter Türkiye as long as they hold valid residence permits.
However, in some cases, a foreign national may realise, whilst abroad that there is very little time left before their residence permit expires.
For example, an Azerbaijani national holding a student residence permit may have travelled to their home country for the summer holidays and, upon returning to Turkey, may find that there are only 15 days left before their residence permit expires.
If a foreign national does not apply to extend their residence permit within this 15-day period and their residence permit expires, they may apply for a student residence permit before the 90-day visa-free period—which begins from the date of their last entry into Turkey—expires. In this case, no penalty will be imposed.
However, as they will be applying under the visa exemption scheme, they must submit their application as if they were applying for the first time, rather than applying for an extension. This rule does not apply to all foreign nationals. The foreign national’s nationality, the duration of their visa or visa exemption, and the conditions for entry into Turkey must be assessed together.
As incorrect actions can lead to a loss of rights, it is of great importance to have one’s personal situation evaluated by experts prior to making an application.
