Türkiye’de çalışma izinleri işveren adına düzenlendiği için, çalışma iznine sahip bir yabancı işten ayrılarak başka bir işyerinde çalışmak istediğinde yeni işveren tarafından yeniden çalışma izni başvurusu yapılması gerekir.
Yeni işveren, başvuruyu kendi e-Devlet ve e-imza sistemi üzerinden gerçekleştirebilir. Ancak başvurunun sorunsuz sonuçlanabilmesi için dikkat edilmesi gereken bazı önemli hususlar bulunmaktadır:
Öncelikle, yabancının mevcut çalışma izninin eski işveren tarafından iptal edilmemiş olması ve bu işyerinde en az altı ay çalışmış olması önem taşımaktadır.
Bunun yanında, uygulamada eski işverenin, yabancının yeni işyerinde çalışmasına muvafakat ettiğini belirten bir dilekçe talep edilmektedir.
Çalışma ve Sosyal Güvenlik Bakanlığı, dosyanın durumuna göre bu dilekçenin noter onaylı olarak sunulmasını da isteyebilir.

Can a Foreign National with a Work Permit Change Their Employer?
As work permits in Turkey are issued in the employer’s name, if a foreign national holding a work permit leaves their job and wishes to work at another workplace, the new employer must submit a new application for a work permit.
The new employer can submit the application via their own e-Government and e-signature systems. However, there are some important points to bear in mind to ensure the application is processed without any issues:
Firstly, it is important that the foreign national’s current work permit has not been revoked by their former employer and that they have worked at this workplace for at least six months.
In addition, in practice, a written statement is required indicating that the former employer consents to the foreign national working at the new workplace.
The Ministry of Labour and Social Security may also require this application to be submitted with a notary’s certification, depending on the status of the case.
